The bill amends Chapter 23-27.3 of the General Laws, known as the "State Building Code," by introducing a new section titled "Construction fencing safeguards." This section prohibits owners, operators, or managers of construction projects from causing, permitting, or authorizing construction sites to be secured with locked chains, gates, fences, or other barriers that obstruct access for vehicles or pedestrians during work hours. It mandates that at least one access point must remain open at all times to allow employees to freely enter and exit the site.

Violations of this new regulation will result in a written warning for the first offense, requiring the operators to unlock any barriers. For subsequent violations, work on the site will be halted until a hearing is conducted with the director of the department of labor and training, and a fine of $1,000 will be imposed for each day the construction site is found to have been locked without an open access point for workers. The act is set to take effect upon passage.
