The bill amends Chapter 16-13 of the General Laws, titled "Teachers Tenure," by introducing a new section, 16-13-10, which outlines the procedures for the termination of noncredentialled employees in schools. It mandates that whenever a noncredentialled employee's employment is terminated for good and just cause by a principal, superintendent, school committee, or other governing body of a public school, private school, school district, charter public school, or mayoral academy, the governing body must report the employee's identity and the reason for termination to the Rhode Island Department of Elementary and Secondary Education within 60 days. This requirement applies even if the termination is appealed, in which case the report must be made within 60 days after the conclusion of the appeal if the termination is upheld.

The requirement does not apply to the nonrenewal of a contract of a noncredentialled employee or to terminations due to fiscal exigency or program reorganization. The Department is tasked with maintaining a confidential list of noncredentialled employees who have been terminated for good and just cause, along with the reasons for their termination. This list will be updated monthly and will be accessible only to hiring authorities of private, parochial, charter, or public schools and school districts. The list shall not be considered a public record.

The bill defines a noncredentialled employee as any person working within or for a school whose employment does not require an educational license or certificate issued by the department, while explicitly excluding certain positions that do require such credentials, including teachers, athletic coaches, teaching assistants, superintendents, administrators, and others in positions requiring a certificate or license. The act will take effect upon passage.
