The bill amends Chapter 46-12 of the General Laws concerning "Water Pollution" by introducing a new section, 46-12-42, which mandates testing of biosolids for PFAS contaminants. Any applicant seeking an order of approval from the Department of Environmental Management for the distribution or land application of biosolids must test their biosolids for PFAS contaminants, as defined by 46-32-2, and submit the results with their application. Additionally, operators with an existing order of approval for the distribution or land application of biosolids are required to test their biosolids quarterly for PFAS contaminants, starting from the October to December 2025 quarter, with the first round of results due by December 31, 2025.
The bill also authorizes the director of the Department of Environmental Management to reject any application for an order of approval if such approval would pose an environmental threat or risk to public health, safety, or welfare. This legislation is set to take effect on September 1, 2025.
