Under this new provision, any such covenant or restriction would be deemed void and unenforceable, with specific exceptions outlined in subsection (b). These exceptions allow for covenants if certain conditions are met, including the prior use of the land for a grocery store, the identification and purchase of a new site for a relocated store within a specified distance, and the timely commencement of operations at the new location.
Additionally, the bill clarifies that the prohibitions do not apply to restrictive covenants or agreements made before the effective date of this section. It also includes a provision stating that if any part of this section is found unlawful by a court, the remaining portions will still remain in effect. The act is set to take effect upon passage.
