The bill amends Chapter 34-4 of the General Laws by introducing a new section, 34-4-31, which prohibits restrictive covenants related to the use of land designated as a retail establishment where fresh food is regularly and customarily sold for off-premises consumption, including grocery stores and supermarkets. Such covenants or restrictions will be deemed void and unenforceable, except under specific conditions outlined in subsection (b).

These conditions allow for the enforcement of covenants if all of the following criteria are met: (1) the land has been used by the seller for a grocery store within the six months prior to the agreement; (2) the seller has purchased land for a new grocery store; (3) the new store is similar in size and scope to the previous one; (4) the new store is located within one-half mile of the previous site; (5) the relocation occurs within one year of closure; and (6) the restrictive covenant does not exceed eighteen months from the date of closure.

The bill also clarifies that the prohibitions do not apply to restrictive covenants or agreements entered into prior to the effective date of this section. Additionally, if any portion of this section is found unlawful by a court, the remaining portions will still be valid. The act is set to take effect upon passage.
