The bill amends Chapter 23-27.3 of the General Laws, known as the "State Building Code," by introducing a new section titled "Construction fencing safeguards." This section prohibits any owner, operator, or manager of a construction project from causing, permitting, or authorizing the construction site to be secured by a locked chain, gate, fence, or other barrier that obstructs access in or out of the construction site by vehicle or on foot during work hours. It mandates that at least one access point must remain open at all times to allow employees working on the site to freely enter and exit.
Violations of this regulation will result in a written warning for the first offense, requiring the operators to unlock any barriers. For subsequent violations, work on the site will be halted until a hearing is scheduled with the director of the department of labor and training, and a fine of $1,000 will be imposed for each day the construction site is found to have been locked without an open access point for workers. The act is set to take effect upon passage.
