Under the new section 23-27.3-101.2, SAVE Units, as defined in 45-24-31, are exempt from most provisions of the State Building Code, except for certain safety and livability standards outlined in section 23-27.3-111.0. These standards include requirements for climate control, safety features such as locking doors and smoke detectors, size specifications, plumbing, and electrical systems.

The bill allows municipalities to construct and use SAVE Units and their accessory units, such as bathrooms, under specific conditions. SAVE Units are permitted by right in municipalities that have allowed such through zoning ordinance provisions or during declared emergencies. It grants municipalities the authority to suspend standard planning and zoning procedures during emergencies, facilitating rapid construction in response to severe weather or disasters.

Municipalities are required to file reports with the governor, the speaker of the house, and the president of the senate regarding the nature of the emergency, actions taken to address it, and the total number of individuals served by the SAVE Units. The bill clarifies that the housing maintenance and occupancy code does not apply to compliant SAVE Units, ensuring that these temporary structures can be utilized effectively while adhering to safety standards. The act will take effect upon passage.
