The bill amends Chapter 39-2 of the General Laws by introducing a new section, 39-2-29, which establishes a process for the removal of double utility poles. A double utility pole is defined as a replacement pole built alongside and attached to another pole for the purpose of transferring electric, telephone, cable, or other utility wires. The owner of the double utility pole is required to notify all users of the pole at least 72 hours before the commencement of removal work. If users fail to remove their wiring and other attachments, the pole owner may impose a penalty, except when the delay is caused by a city or town's failure to remove its police or fire alarm circuits or similar municipal equipment.

Furthermore, electric distribution companies or telephone companies must complete the transfer of wires, all necessary repairs, and the removal of the old pole within 30 days of installing the new pole. Failure to remove the old pole within this timeframe will result in a daily penalty of up to $100, enforced by the division of public utilities and carriers. Any fines collected for violations of this section will be donated to the low-income home energy assistance program. The division of public utilities and carriers is responsible for administering and enforcing these provisions and will promulgate rules and regulations necessary to effectuate the purposes of this section. The act will take effect upon passage.
