The bill amends Chapter 39-2 of the General Laws by adding a new section, 39-2-29, which establishes a process for the removal of double utility poles. A double utility pole is defined as a replacement pole built alongside and attached to another pole for the purpose of transferring electric, telephone, cable, or other utility wires. The owner of a double utility pole is required to notify all users of the pole at least 72 hours before the commencement of removal work. If users fail to remove their wiring and other attachments, the pole owner may impose a penalty, except in cases where the failure of a city or town to remove its police or fire alarm circuits or similar municipal equipment causes the delay.

Furthermore, electric distribution companies or telephone companies must complete the transfer of wires, all repairs, and the removal of the old pole within 30 days from the date of the installation of the new pole. Failure to remove the old pole within that timeframe will result in a daily penalty of up to $100 imposed by the division of public utilities and carriers. Any fines collected for violations of this section will be donated to the low-income home energy assistance program. The division of public utilities and carriers is responsible for administering and enforcing the provisions of this section and will promulgate rules and regulations necessary to effectuate its purposes. The act will take effect upon passage.
