The bill amends Chapter 39-2 of the General Laws, introducing a new section, 39-2-29, which establishes a framework for the removal of double utility poles. A double utility pole is defined as a replacement pole built alongside another for the purpose of transferring utility wires. The owner of a double utility pole is required to notify all users of the pole at least 72 hours before the removal work begins. If users fail to remove their wiring and attachments, the pole owner may impose a penalty, except when the delay is caused by municipal equipment such as police or fire alarm circuits.

Additionally, electric distribution and telephone companies must complete the transfer of wires and the removal of the old pole within 30 days of installing a new pole, or they will incur a daily penalty of up to $100. The bill stipulates that any fines collected for violations will be donated to the low-income home energy assistance program. The division of public utilities and carriers is tasked with administering and enforcing these provisions and will also create necessary rules and regulations to implement the section. The act will take effect upon passage.
