The bill amends sections 6-31-1 and 6-31-3 of the General Laws in Chapter 6-31, which pertains to "Unit Pricing." It introduces a new definition for "electronic shelving label," which is defined as any remote-controlled digital display used to indicate the retail, unit, and/or total price to the ultimate consumer. The bill specifies that persons subject to the requirements of section 6-31-2 must disclose the unit price and total price of the commodity in Arabic numerals when a computerized system is used. Importantly, it states that an electronic shelving label alone shall not satisfy the disclosure requirements for unit pricing, which must also include the attachment of a stamp, tag, or label to the commodity. Additionally, the bill includes a provision stating that if any portion of this section is found by a court of competent jurisdiction to be unlawful, such a finding shall not affect any other portion of this section not specifically found to be unlawful. This act is set to take effect upon passage.
