The bill amends Chapter 31-15 of the General Laws, introducing a new section, 31-15-20.1, which permits lane splitting by motorcycles under specific conditions. Lane splitting is defined as the act of a motorcycle driving between rows of stopped or moving vehicles in the same lane. The conditions for lane splitting include that traffic must be stopped or moving at a speed of no more than ten miles per hour, the motorcycle operator must not exceed ten miles per hour above the current traffic flow, and the posted speed limit on the highway must be greater than fifty miles per hour. Additionally, the motorcycle operator is required to merge with traffic once the speed limit is reached.
The bill also grants the administrator the authority to develop necessary rules and regulations in consultation with the department of public safety. Notably, the provisions allowing lane splitting will cease on January 28, 2023, and the act will take effect upon passage, with a sunset date set for January 31, 2026. This legislation aims to provide a legal framework for lane splitting, enhancing the safety and efficiency of motorcycle operation in congested traffic conditions.
