The bill introduces a new chapter, Chapter 167, titled "Detention for Federal Civil Immigration Violations," to Title 42 of the General Laws. It prohibits state and municipal governmental officials or agencies from entering into or renewing any contracts, intergovernmental service agreements, memoranda of understanding, or any other agreements to detain individuals for federal civil immigration violations. Any existing contracts related to such detentions must be terminated by July 1, 2026.
Additionally, the bill prohibits the use of public resources to facilitate the detention of individuals for federal civil immigration violations. This includes restrictions on selling, trading, leasing, or otherwise disposing of public property for the establishment or operation of detention facilities, using governmental funds for related costs, receiving payments for detainee services, and providing any financial incentives or benefits in connection with such facilities. The act is designed to ensure that no state or municipal resources are utilized in connection with federal civil immigration detentions and will take effect upon passage.
