The bill amends Section 37-14.1-6 of the General Laws in Chapter 37-14.1, which pertains to "Minority Business Enterprise" participation in state procurements and construction projects. The key changes include increasing the minimum percentage of contract awards to minority business enterprises from fifteen percent (15%) to twenty percent (20%). Additionally, the bill specifies that within this twenty percent, at least ten percent (10%) must be awarded to minority-owned businesses and another ten percent (10%) to women-owned businesses. The previous requirement for a report on participation status by the Department of Administration has been removed.

Furthermore, the bill establishes that any minority business enterprise certified by the U.S. Small Business Administration as an 8(a) firm will automatically be recognized as certified by the Department of Administration, requiring only proof of federal certification. It also mandates that the provisions of this chapter remain in effect during declared states of emergency and calls for a disparity study to assess the need for programs that enhance participation of women and minority-owned businesses in state contracts, to be conducted every five years starting in fiscal year 2025. The act will take effect upon passage.
