The bill amends Section 5-31.1-39 of the General Laws concerning public health dental hygienists, allowing them to perform dental hygiene procedures in public health settings without the immediate supervision of a dentist. The definition of public health dental hygienists is clarified, and the settings in which they can operate are expanded to include residences of the homebound, schools, nursing homes, clinics, and other facilities approved by the Department of Health. Additionally, public health hygienists are required to enter into a written collaborative agreement with a local or state agency or a licensed dentist to ensure proper communication and consultation regarding patient health and safety.
Furthermore, the bill introduces a consent form that must be provided to patients or their legal guardians, outlining the services to be rendered and emphasizing the importance of obtaining a dental examination by a dentist within 90 days after the procedure. A significant change in the reimbursement process is also included; public health dental hygienists may now seek reimbursement from other insurance or third-party payors, such as Medicare, in addition to Medicaid. The previous restriction that they "shall not" seek such reimbursements has been replaced with "and may," allowing for greater financial support for their services. This act will take effect upon passage.
