The proposed "Fairness in Women's Sports Act" aims to establish guidelines for the categorization of athletic teams based on biological sex rather than gender identity. Under this act, all interscholastic, intercollegiate, intramural, or club sports sponsored by public schools or higher education institutions must be designated as either male, female, or coed. Teams designated for females will not be open to students of the male sex. In cases of disputes regarding a student's sex, a signed physician's statement will be required, which must assess the student's sex based on reproductive anatomy, testosterone levels, and genetic makeup.

The act also provides protections for educational institutions against complaints, investigations, or adverse actions related to maintaining separate teams for female athletes. It establishes a private cause of action for students who are deprived of athletic opportunities or suffer retaliation due to violations of the act, allowing them to seek injunctive relief, damages, and other available legal remedies. Additionally, any school or institution of higher education that suffers harm due to a violation of the act may also pursue a private cause of action. The provisions of the act are declared severable, ensuring that if any part is deemed invalid, the remaining sections will still be effective. This act is set to take effect on January 1, 2026.
