The proposed bill amends Title 42 of the General Laws by adding a new chapter, Chapter 167, titled "Detention for Federal Civil Immigration Violations." This chapter establishes a prohibition against state and municipal government officials or bodies from entering into, renewing, or agreeing to any contracts or agreements that would facilitate the detention of individuals for federal civil immigration violations. This includes intergovernmental services agreements and any leases that would allow the use of public property for such purposes. Additionally, any existing agreements related to the detention of individuals for federal civil immigration violations must be terminated by July 1, 2025.

The bill also includes a severability clause, ensuring that if any part of the chapter is deemed unconstitutional or invalid by a court, the remaining provisions will still remain in effect. The act is set to take effect upon passage, reinforcing the commitment of state and local governments to refrain from participating in federal civil immigration enforcement through detention agreements.
