This bill amends Section 23-13-22 of the General Laws to place the early intervention program for developmentally disabled infants under the jurisdiction of the Executive Office of Health and Human Services (EOHHS). It mandates that all developmentally disabled infants from birth to three years of age be enrolled in this program. Beginning July 1, 2025, EOHHS is required to create a plan that allows children to remain in early intervention services until the September following their third birthday, in accordance with federal law. The bill outlines a phased implementation, starting with children who turn three between April 1, 2028, and August 31, 2028, and expanding to all eligible children by September 1, 2029.

The bill also requires EOHHS to develop and maintain procedures for the earliest possible identification of infants needing services and to ensure that every infant identified and referred to the program is notified in writing within thirty calendar days. Additionally, it stipulates that regulations governing the delivery of services under this program, including eligibility regulations, will be promulgated by EOHHS. The act will take effect upon passage.
