The proposed bill introduces a new chapter, CHAPTER 91.2, titled the "School and Youth Programs Concussion Act," which aims to enhance the management of concussions in interscholastic athletic activities. It mandates the establishment of concussion oversight teams within public, charter, and private schools that have students participating in such activities. These teams are responsible for creating protocols for students' return to play and return to learn after a suspected concussion, based on peer-reviewed scientific evidence and guidelines from the Centers for Disease Control and Prevention.
The bill requires that students and their guardians sign a form acknowledging receipt of information regarding concussion prevention, symptoms, treatment, and oversight before participating in interscholastic athletics. It also outlines specific procedures for the immediate removal of students from practice or competition if a concussion is suspected, allowing for removal by coaches, physicians, game officials, athletic trainers, parents or guardians, the student themselves, or any other designated person under the school's return-to-play protocol.
Students removed from practice or competition due to a suspected concussion cannot return until they have been evaluated and cleared by a qualified healthcare professional, and they must meet the requirements of both the return-to-play and return-to-learn protocols established by the concussion oversight team. The existing chapter 16-91, which previously governed concussion management in youth sports, will be repealed in its entirety. This new legislation is set to take effect on July 1, 2025.
