The bill amends Chapter 30-2 of the General Laws regarding the organization and command of military and naval forces in Rhode Island. It introduces a new section, 30-2-10.1, which stipulates that the Rhode Island National Guard and its members shall not be released from state control into active duty combat unless the United States Congress has passed an official declaration of war pursuant to Article 1, Section 8, Clause 11 of the U.S. Constitution or has taken official action pursuant to Article I, Section 8, Clause 15 to explicitly call forth the Rhode Island National Guard for the purposes of executing the laws of the union, repelling an invasion, or suppressing an insurrection. The governor is required to take all actions necessary to comply with the requirements of this section. This act is designed to take effect immediately upon passage.
