This bill amends Chapter 11-9 of the General Laws entitled "Children" to add a new section regarding the care of babies born preterm. The new section states that any physician, nurse, or other licensed medical person who knowingly and intentionally fails to provide reasonable medical care and treatment to an infant born alive will be guilty of a felony. If the infant dies as a result of this failure, the medical person will be guilty of manslaughter. However, the requirements of this section do not prevent an infant's parents or guardians from refusing consent to medical treatment or care that is not medically necessary or reasonable. The bill defines "born alive" as the complete expulsion or extraction from the mother of a member of the species homo sapiens, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut or the expulsion or extraction occurs naturally or through medical intervention. The bill would take effect upon passage.
