The bill amends sections of the General Laws in Chapter 34-36.1, known as "Condominium Law," to include new provisions regarding the applicability of the chapter to condominiums created before July 1, 1982, and to establish requirements for meetings of condominium associations. Specifically, it introduces 34-36.1-1.02, which clarifies that condominiums created prior to this date may voluntarily accept the provisions of the chapter, and 34-36.1-3.08, which outlines the requirements for meetings and notice. The bill mandates that a meeting of the association must be held at least once each year and allows special meetings to be called by the executive board upon request from unit owners holding at least twenty percent (20%) of the votes in the association for specific purposes. It also stipulates that the notice of any meeting must state the time and place of the meeting and the items to be discussed. Furthermore, the bill allows for electronic participation in meetings, enabling condominium associations to conduct regular or special meetings via telephonic or video conferencing, thus accommodating unit owners who may not be able to attend in person. The notice requirements for meetings are updated to include electronic delivery options, provided that unit owners have consented to receive such notices electronically. This includes the option to provide notice via email or by posting on a secure website or portal of the association. The act will take effect upon passage.
