The proposed "School Food Dye Restriction Act" aims to protect the health and well-being of Rhode Island residents, particularly children, by restricting the use of certain artificial food dyes in foods distributed within schools. The act identifies specific artificial food dyes, including FD&C Blue No. 1 and 2, FD&C Green No. 3, FD&C Red No. 40, and FD&C Yellow No. 5 and 6, which are linked to adverse health effects such as behavioral issues and allergic reactions. Beginning January 1, 2027, no food products containing these dyes will be allowed on school campuses, which encompasses all areas accessible to students during the school day.
To ensure compliance, the act mandates that school food service vendors adhere to these restrictions and outlines enforcement measures, including civil fines for violations. The Department of Health will oversee enforcement and develop guidelines to assist schools in implementation. Additionally, a restricted receipt account will be established to manage fines collected, which will support food safety education initiatives. The Department of Health is also required to report annually to the General Assembly on the act's implementation and effectiveness, starting January 1, 2028.
