Additionally, the bill adds a new section, 12-1-10.2, which outlines the procedures for firearms examination in cases involving crime guns. It specifies that if a firearm is seized and is not classified as a crime gun, no ballistic testing will occur. If an individual is acquitted of charges related to a firearm, they may file a motion with the court to request the deletion of ballistic test records from NIBIN and any other database, unless the firearm is relevant to another criminal investigation or prosecution. The act is set to take effect upon passage.
