The bill introduces a new chapter, CHAPTER 128.4, titled "Emergency Shelters," to Title 42 of the General Laws concerning state affairs and government. It defines "emergency shelter" as a facility with overnight sleeping accommodations primarily intended to provide temporary shelter for the homeless, either in general or for specific populations. The Rhode Island Housing Resources Commission is established as the licensing agency responsible for issuing licenses for these shelters.

The commission is required to create an application process for emergency shelter licenses by January 1, 2026. Upon receipt of an application, the licensing agency must issue a license if the applicant meets the established requirements. The license will be the property of the state, loaned to the licensee, and must be posted in a conspicuous place on the licensed premises. Any emergency shelter established due to a natural disaster or other significant events will be exempt from these licensing requirements.

The bill outlines minimum standards for licensed emergency shelters, which include providing a safe place for residents, making drinking water and proper bathroom facilities available, developing written policies regarding privacy and confidentiality, and establishing procedures for the safe transfer of individuals who can no longer reside at the shelter. The Housing Resources Commission is tasked with promulgating additional minimum shelter standards for shelters that receive state funding by December 1, 2026.

Furthermore, the commission must develop a grievance procedure to address complaints from individuals who have resided or attempted to reside in any emergency shelter, which must also be posted in a conspicuous place on the premises. The bill prohibits any fees or payments for shelter services and personal care items, with exceptions for specific financial literacy programs that allow resident funds to be returned upon request. The act will take effect upon passage.
