The bill proposes amendments to Section 36-10-36 of the General Laws, which pertains to the post-retirement employment of members who have retired under the provisions of title 16, 36, or 45. It stipulates that retired members who return to work for any state agency or department must suspend their retirement benefits during their reemployment, and they will not accrue additional service credits or retirement contributions. However, the bill allows retired members to work for a municipality without impacting their retirement benefits if they do not exceed certain working day limits, and it requires monthly reporting of such employment to the retirement board. The bill also carves out exceptions for retired members to serve in elected or appointed positions, or to work part-time as teachers, state college or university employees, or registered nurses, without losing retirement benefits, subject to income or working day restrictions. Additionally, it permits retired general magistrates and district court clerks/magistrates to perform services post-retirement without affecting their retirement benefits, with district court clerks/magistrates eligible for additional pay and benefits.

Furthermore, the bill allows retired members to be appointed as municipal employees by the highest elected chief executive officer in any city or town under certain fiscal oversight conditions without forfeiting their retirement benefits, and no additional service credits will be granted for such service. It also introduces a provision for retired certified or qualified court interpreters to be re-employed on a per-diem basis within the unified judicial system without forfeiting retirement benefits, limited to seventy-five full working days or one hundred fifty half-pay days per calendar year. Exceeding this limit will result in the suspension of pension payments, and no additional contributions or service credits will be granted. Employers and retired members must notify the retirement board of such employment monthly. The act will take effect upon passage.
