The bill proposes an amendment to Chapter 12-2 of the General Laws, specifically by adding a new section titled "Privacy protections for railway employees." This new section stipulates that any police report related to a railroad fatality, as well as communications between police officers and railroad crew members involved in such an incident, shall remain confidential and not be made public. However, these reports and communications can be accessed upon written request by the host railroad, the railroad of employment of any employee mentioned in the reports, or any other person authorized by judicial order if necessary for their duties. Additionally, law enforcement officers and the office of the attorney general can access these reports upon written or electronic mail request.
The bill also outlines that communications concerning a railroad fatality may be shared with any person listed in the aforementioned subsection if required for their duties. A violation of this new section would be considered a misdemeanor, punishable by imprisonment for not more than one year, a fine of not more than ten thousand dollars ($10,000), or both.
