The bill amends the General Laws in Chapter 34-36.1, known as the "Condominium Law," to make several changes regarding the applicability of the chapter and the requirements for bylaws of condominium associations. The bill specifies that the chapter applies to all condominiums created in the state after July 1, 1982, but condominiums created before this date may voluntarily accept the provisions of this chapter. It also clarifies which sections of the law apply to condominiums created before July 1, 1982, and states that these sections apply only to events and circumstances occurring after that date without invalidating existing provisions. Additionally, the bill outlines that the Condominium Ownership Act does not apply to condominiums created after July 1, 1982, and does not affect amendments to the declaration, bylaws, plats, and plans of condominiums created before this date.

The bill also includes new language requiring the bylaws of the association and any rules referenced in the declaration or bylaws, along with any amendments, to be recorded in the municipal land evidence records in every municipality where any part of the condominium is located. Furthermore, it mandates that bylaws and rules recorded after the recording of the declaration must be certified by two members of the executive board, unless the declaration or bylaws require greater certification. The bill would take effect upon passage and includes an explanation that it aims to require the recording of the bylaws and rules of the association in the land evidence records of the city or town where the condominium is located, and that amendments to the original filings must be certified by two members of the executive board.
