The bill proposes an amendment to Title 23 of the General Laws, adding a new chapter titled "Bed Bugs in Residential Premises Act." This chapter defines key terms related to bed bug infestations and outlines the responsibilities of tenants and landlords. Tenants must promptly notify their landlords of the presence or suspicion of bed bugs, and landlords are required to inspect the affected unit within 96 hours of notification. If bed bugs are found, the landlord must also inspect contiguous units and begin treatment within five business days, bearing the costs unless tenant noncompliance necessitates further treatment. Tenants are responsible for preparing their units for inspection and treatment and must comply with the pest control agent's measures.

The bill also includes provisions to prevent the renting of infested units, requiring landlords to disclose past infestations to prospective tenants and inform current tenants of the last inspection date. Tenants are guided on how to handle infested property but are prohibited from disposing of it in common areas. Legal remedies for noncompliance are established, with landlords facing liability for actual damages and the ability to seek injunctive relief against noncompliant tenants. The bill amends Section 45-24.3-6 of the General Laws to require compliance with the new bed bug chapter and exempts those who comply from certain existing conditions. The bill is set to take effect upon passage.
