This bill, titled the "Surplus Funds Tax Credit Act," would amend Title 44 of the General Laws to establish a tax credit for taxpayers if net state tax revenues in any fiscal year exceed the projected revenue estimates. The amount of the excess would be determined by the state budget officer and reported to the director of the department of revenue. The excess amount would then be refunded to taxpayers in proportion to their personal income tax liability incurred in the previous taxable year. The director would calculate the percentage to determine the amount of the refund in dollars. The bill also allows taxpayers to petition the supreme court or superior court to enforce the provisions of this chapter, with the possibility of recovering attorneys' fees and other costs from the state. The director would have the authority to promulgate rules and regulations to implement the provisions of this chapter. The act would take effect on July 1, 2024.
