The bill amends Section 36-10-36 of the General Laws in Chapter 36-10, titled "Retirement System — Contributions and Benefits," to address post-retirement employment of members who have retired under the provisions of titles 16, 36, or 45. The amendment includes a new provision (insertion) that allows retired public safety officers to seek secondary employment as state or municipal employees without any forfeiture or reduction of their retirement benefits and allowances. This is in addition to existing provisions that permit retired members to serve in various elected or appointed positions, such as mayors, administrators, council members, school committee members, or members of state or municipal boards or commissions, without losing retirement benefits, provided no additional service credits are granted for such service.
The bill also specifies conditions under which retired members may be employed or reemployed on a part-time basis by state colleges, universities, schools, or state-operated facilities, including as faculty members or in professional nursing care, without affecting their retirement benefits. It sets limits on the gross pay for part-time work and requires that pension payments be suspended if employment exceeds the specified number of working days or half days in a calendar year. Notices of such employment must be sent monthly to the retirement board by both the employer and the retired member. The bill would take effect upon passage, allowing retired public safety officers to immediately benefit from the new provision without impacting their retirement benefits.
