This bill, if passed, would amend Chapter 5-34 of the General Laws entitled "Nurses" by adding a new section. The new section would make any contract or agreement that restricts the right of an advanced practice registered nurse (APRN) to practice void and unenforceable. This includes restrictions on practicing in a certain geographic area, providing treatment or establishing a professional relationship with any other employer, and soliciting or seeking to establish a professional relationship with any current patient of the employer. However, the prohibition on restrictive covenants would not apply in connection with the purchase and sale of a practice, as long as the restrictive covenant and non-compete covenant is for a period of time not exceeding five years. The bill would take effect upon passage.
