This bill adds a new section to Chapter 27-20.8 of the General Laws entitled "Prescription Drug Benefits" that establishes a co-pay cap for prescription asthma inhalers. The bill defines "prescription asthma inhaler" as a prescribed medical device used to treat asthma, and specifies that it does not include over-the-counter inhalers. Under the bill, health plans that provide coverage for prescription asthma inhalers must cap the total amount that a covered person is required to pay for a covered prescription asthma inhaler at $25. This coverage would not be subject to any deductible. The bill also allows the office of the health insurance commissioner to enforce compliance with this section and to promulgate rules and regulations as necessary.

The bill will take effect on January 1, 2025.
