The bill amends Chapter 6-45 entitled "Consumer Enforcement of Assistive Technology Device Warranties" to enhance consumer rights regarding the repair and warranty of assistive technology devices. It defines a "reasonable number of attempts to repair" as either the same nonconformity being repaired two or more times during a specified term, or the device being out of service for 30 or more calendar days due to nonconformities. It also specifies how to count the days a device is out of service and requires manufacturers/vendors to keep detailed written records of all repair attempts, including dates, types of repairs, duration, results, and the total number of attempts.

Additionally, the bill mandates that at the time of purchase or lease, the manufacturer must provide the consumer with a clear statement of their rights under the law, including entitlements to a replacement or refund after a certain number of failed repair attempts or if the device is out of service for an extended period. The statement must also inform the consumer of their right to a loaner device if the original is out of service for more than seven days or if not having a device poses a safety threat. The act aims to make it easier for consumers to enforce their rights and increases awareness of the law by requiring notice of these rights at the time of sale. The act will take effect upon passage.
