The bill proposes an amendment to Chapter 16-21 of the General Laws, titled "Health and Safety of Pupils," by adding a new section that mandates universal behavioral health screenings in Rhode Island public schools. The Rhode Island Department of Elementary and Secondary Education (RIDE) is tasked with partnering with knowledgeable providers and offering guidance to local education agencies (LEAs) on screening methods. By June 30, 2024, all public schools are required to screen every enrolled student for behavioral health concerns. Starting September 1, 2025, screenings will be specifically conducted for students in third grade, eighth grade, and those who enroll from out-of-state districts during their first academic year in Rhode Island. Parents or guardians have the option to opt out of the screenings for their children.
The bill also stipulates that the results of the screenings must be provided to the student, if they are over eighteen, or to the student's parents or guardians within thirty days after the screening is completed. Additionally, the bill clarifies that schools or LEAs may conduct additional mental or behavioral health screenings beyond those required by this chapter. The act would become effective immediately upon passage.
