The bill amends Chapter 21-27.2 of the General Laws, changing its title from "Single-Use Plastic Straws" to "SINGLE-USE PLASTIC STRAWS, FOODWARE ACCESSORIES, AND CONDIMENTS." It introduces new definitions and regulations regarding single-use items provided by food service establishments. The definition of "single-use foodware accessory" is added to include utensils, condiment cups, straws, and similar items. The term "standard condiment" is also defined to cover common add-ons like ketchup, mustard, and sugar.

The bill stipulates that food service establishments may not provide single-use plastic straws or foodware accessories unless requested by the consumer. It also requires that only the necessary single-use foodware accessories for consuming ready-to-eat food be provided upon request, and prohibits the bundling of these items. Third-party delivery platforms must allow customers to request single-use accessories or standard condiments, and only provide what is requested. Self-serve and bulk dispensed single-use foodware accessories and standard condiments are permitted. Exemptions are made for correctional facilities, licensed healthcare facilities, and residential care facilities. The act is set to take effect on January 1, 2024.
