Please join me in helping to keep our health care providers and maternity services open by amending existing MCARE language to clarify that medical liability payments are not assessed interest before a payment is due. In short, if a medical liability payment is not late, a provider should not have to pay millions in interest outside of the actual award on payments that are made in increments.

In August 2026, the Pennsylvania Superior Court upheld a $207 million Philadelphia birth injury award. The judgment included $100 million for future medical expenses; interest on those estimated future treatment payments added another $24 million in damages. Massive cases like this are placing significant additional financial pressure on providers and contributing to the suspension of maternity services and the closure of providers across Pennsylvania.

My bill does not limit compensation awarded to the plaintiff or alter future medical payments. Rather, it ensures that providers are not unfairly assessed additional charges on payments which are not yet due by clarifying existing MCARE language that prejudgment interest, post judgment interest, and delay damages are not added to future periodic payments.

Help keep Pennsylvania providers and maternity services open. Please join me in co-sponsoring this legislation.
