In 2024, the U.S. Food and Drug Administration extended the shelf life of certain naloxone products by a year, although further research has demonstrated that naloxone may be used long after its expiration date with limited effects on the product’s effectiveness. Other states have started taking action, with Kansas recently enacting a law that allows for the use of expired naloxone, and other states introducing similar legislation.
 
Using expired naloxone has been shown to be safe, effective, and presents a potential cost-saving opportunity. For those reasons, I plan to introduce legislation allowing for the use of expired naloxone for up to five years past its expiration date. My legislation will also extend immunity provisions for the distribution and administration of expired naloxone within those parameters.
