I am introducing legislation to improve roadway safety and incident clearance by standardizing reimbursement procedures for towing and recovery services directed by public safety agencies.

The bill establishes a clear framework for documenting and reimbursing reasonable and necessary towing and recovery services performed under the direction of roadway authorities or public safety entities. It is intended to ensure consistent compensation for operators assisting in clearing roadway incidents, restoring traffic flow, and supporting first responders.
To ensure accountability and fiscal integrity, the proposal requires standardized documentation, including incident reports, authorization records, and itemized invoices, consistent with Federal Highway Administration incident response best practices.

Primary payment responsibility remains with vehicle owners or insurers, with reimbursement limited to cases where recovery from those parties is not reasonably obtainable. The Department of Transportation would administer claims, establish procedures and reimbursement limits, and provide annual reporting on approvals, denials, and expenditures.
