Our laws should be easily accessible and understandable. Sometimes, that means the General Assembly must consolidate multiple laws into one location.
 
In 2022, the General Assembly passed legislation, now known as Act 146, that overhauled Pennsylvania law on utilization management. Health insurers use a variety of utilization management tools, such as prior authorization, to control how much they pay for health care. Mechanically, Act 146 amended the Insurance Company Law of 1921.
 
Before Act 146 was adopted, the General Assembly passed freestanding legislation addressing utilization management of stage four cancer drugs. This legislation was championed by Representative Benninghoff. That legislation, now known as Act 6 of 2020, was not included in Act 146.
 
When multiple freestanding laws addressing the same issue are enacted at different times, consumers struggle to know what legal protections they are entitled to. To bring clarity to the law, we will introduce legislation that consolidates Act 6 into the Act 146 amendments to the Insurance Company Law.
