In the near future, I will be introducing legislation to update Title 30, regarding operating watercraft under the influence (BUI) and establishing consistency with the driving under the influence (DUI) of alcohol or controlled substance statute. This change ensures constitutionality, increases penalties for warrantless blood or breath refusals, and helps address repeat BUI offenders.

In 2018, Pennsylvania amended the DUI law to make most third or subsequent DUI offenses a third-degree felony. The current BUI law does not contain this change. This legislation provides increased penalties for refusal of chemical testing and would mirror the updated DUI law.

These proposed enhancements would help modernize and strengthen the BUI law to be consistent with DUI provisions. Please join me as a co-sponsor to establish uniformity and help keep the public safe on our waterways.
