In the near future, I intend to introduce legislation that will require political advertisements to disclose if artificial intelligence was used in its creation. This legislation is modeled off existing state law which requires disclosure when taxpayer dollars are used to create an advertisement.

It is well documented that the use of artificial intelligence has grown exponentially across nearly every domain of our lives. With each iteration, these models become more sophisticated and capable of increasingly complex tasks - and sometimes even human-like outputs. 

The emergence of generative AI has made it much easier to create videos or print images. New applications launch every day that put incredibly powerful text-to-video tools in the hands of millions, a clear signal that AI companies see video generation as a core feature for consumers. AI-generated images are already exceedingly prevalent on social media. A Harvard study from 2024 found that some of the most popular posts on Facebook contained AI-generated images.

Given the significant uptick in AI-generated images and video, it is not surprising that they have bled into the political world and political advertising. A 2025 study by the American Association of Political Consultants found that a clear majority of political consultants and ad-makers use AI tools on a daily basis. While not always malicious, these tools pose real harm and the opportunities to present misinformation or deceive the public are abundant.

26 states have already enacted laws that would regulate the use of AI in political advertising and campaigns. As we approach the 2026 midterms, all signs point to AI-generated political content reaching an all-time high.
