In the near future, I plan to introduce legislation allowing for a medical recall exemption for individuals with heart conditions who have treated their conditions with pacemakers.

Under PennDOT's current regulations, an individual reported as having fainting spells is determined unqualified to drive by physical standards, causing their licensed to be revoked. As of now, the license is suspended for 6 months at minimum, provided the person does not have further fainting spells from the date of suspension. While many medical conditions do not have procedures available that would eliminate re-occurrence, this is not the case for certain heart conditions. The installation of a pacemaker ensures that fainting as a result of heart conditions cannot physically occur. As such, the regulation is redundant, presenting unnecessary challenges for constituents who have had pacemakers installed.

My legislation updates PennDOT’s medical recall process to ensure those with heart conditions, who have had pacemakers installed, are not deprived of driving privileges for six months.Once PennDOT receives confirmation from the individuals'doctor that a pacemaker has been implanted, preventing future fainting spells, PennDOT will deem the individual physically qualified to drive. The legislation would not apply to CDL drivers and physicians' reports will not be held liable.

I hope you’ll join me in cosponsoring this important legislation, giving back the essential ability to drive to individuals with pacemakers.
