Private water wells are the primary source of drinking water for more than 3 million Pennsylvanians, particularly in rural areas. Despite this, the Commonwealth is one of only two states that does not enforce industry standards for well siting and construction, and one of just three states that does not have statewide industry licensing requirements. The proper siting and construction of private wells is critical for safeguarding water quality, protecting public health, and protecting consumers. This is especially true in Pennsylvania, which has a complex and diverse subsurface geology.

We are introducing legislation that establishes greater accountability within the water well drilling industry by creating a licensing framework for drillers under the Pennsylvania Department of State. This framework will uphold existing industry standards and level the playing field—without adding additional regulatory requirements or complicated permitting processes. It will allow well drillers to choose either an expert or specialized pathway to licensing, creating a flexible framework for workers to pursue only the training or experience relevant to their specialty. It also includes a two-year grandfathering period to ensure continuity of the industry.

This legislation pertains only to water, geotechnical, environmental, and geothermal drillers that install groundwater heat pump systems. It specifically excludes oil and gas activity as this industry is already regulated and licensed elsewhere in statute. This bipartisan legislation has been highly vetted and is supported by representatives from the oil and gas, agricultural, building, engineering, and drilling industries, as well as state agencies, consumer, health, and environmental groups.
