Homeownership has long been one of the most reliable pathways to financial stability and the creation of generational wealth. Yet for far too many Pennsylvania families, the ability to pass a home on to the next generation is hindered by “tangled” or unclear property titles. As recommended by the Governor’s Housing Action Plan, I am introducing legislation to address this consequential issue.

Unclear titles most often arise when a homeowner passes away, and the heirs continue to live in the home without formally updating the property records. When the title remains in the deceased owner’s name, families face significant barriers; they may be unable to sell the property, secure financing, or access grants or home repair programs that require clear ownership documentation.
 
This challenge disproportionately affects working class Pennsylvanians, particularly individuals who lack access to legal resources or who inherit homes that represent the bulk of their family’s wealth. Without a clear and accessible process to resolve these titles, families risk losing homes that have been in their families for generations.

The legislation, which has been introduced in the House by Representative Scott as House Bill 2172, creates a framework for counties to efficiently resolve unclear titles with small estate primary residence affidavits. These affidavits would apply to primary residences with an assessed value under $150,000, ensuring that families with limited means have a practical path to securing legal ownership. By simplifying this process, we remove unnecessary barriers and help families protect and build upon the wealth their parents and grandparents worked hard to create.
