In 2024, the General Assembly took action to rein in PBMs that were destroying local pharmacies and jeopardizing the health and safety of Commonwealth residents. While these reforms were an important step forward, more must be done to protect access to essential medical care.
 
Our legislation will authorize the Office of Attorney General to review all contractual renewals and terminations between pharmacies and PBMs to assess their impact on local communities. Any disputed termination will require a public hearing in the affected community. The Office of Attorney General will also be empowered to represent the interests of impacted patients in any action necessary to protect the Commonwealth and its residents.
 
Additionally, the legislation will require PBMs to appear in the courts of the Commonwealth for any cause of action arising from conduct within Pennsylvania. Residents should not be forced to travel across the country to defend their access to essential medical care.
 
To streamline government processes, the legislation will require the Board of Pharmacy to automatically notify PBMs of any disciplinary action taken against a pharmacy by the DEA or the Board. Furthermore, PBMs will be prohibited from directly owning a pharmacy license in the Commonwealth.
 
Finally, our legislation will expand the contractual limitations established in Act 77 of 2024 by ensuring that termination cannot occur solely based on the successful completion of corrective action plans and other limitations designed to protect fair business practices and patient access to care.
