While artificial intelligence (AI) has high potential for various economic sectors, it must develop in a way that puts people first. Pennsylvania, like many other states, has actively worked to pass legislation that creates reasonable guardrails for AI. However, provisions proposed in federal legislation, and most recently, an executive order from President Trump, have sought to limit the sovereignty of states to regulate AI. The executive order signed early in December 2025 outlined the White House’s intention to litigate against state AI laws and withhold state broadband funds for states that do not comply by their demands.
 
Attempts to create a federal AI moratorium undermine the principles of federalism, and Pennsylvania must maintain its right to legislate on matters related to AI. This resolution affirms this right, while also urging Congress and the White House against efforts to create a federal moratorium on state AI legislation.
 
States must be able to legislate freely on AI to uphold standards for responsible use. Across the country, state legislatures have rejected a federal AI moratorium on a bipartisan basis. This resolution puts Pennsylvania among those states.
