Effective law enforcement hinges on collaboration among federal, state, and local agencies. The combination of resources, expertise, and intelligence between these agencies facilitates more efficient identification, apprehension, and subsequent prosecution of individuals engaged in criminal activity. Although jurisdiction overlaps amongst these agencies, state and local law enforcement operate independently from Federal Bureau of Investigation and other federal entities. This overlap (dual sovereignty) allows all levels of government to address violations of both state and federal law while respecting constitutional boundaries.

Recent events have demonstrated a breakdown in this cooperative framework. The murders of community members in Minnesota by federal immigration law enforcement agents constitute a potential violation of both state and federal statutes. These incidents are severe on their own, but when they are accompanied by lack of transparency and meaningful oversight, the nation is left with serious concerns that federal immigration authorities acted beyond the scope of their lawful authority.

Following the incidents, state and local authorities initiated independent investigations but encountered obstruction from the Trump Administration. Such interference undermines the rule of law and compromises the ability of states to protect their residents and enforce their own criminal statutes. States must act decisively to prevent federal interference in lawful investigations and preserve the integrity of state and local law enforcement.

Consequently, we intend to introduce legislation establishing a framework for joint oversight within the Commonwealth. This legislation will strengthen the authority of state and local jurisdictions to investigate and, where appropriate, prosecute alleged criminal conduct including incidents involving the use of excessive force by federal agents.

The consequences of obstructing or tampering with an investigation must reflect the gravity of these crimes. State and local authorities in Pennsylvania have both a legal and moral obligation to pursue justice without fear or favor. No individual is above the law, and no official possesses absolute immunity from accountability.
