Following President Trump’s call to nationalize elections, some of his allies have proposed deploying United States Immigration and Customs Enforcement (ICE) agents to polling places during the 2026 midterm elections. This effort to nationalize our elections and deploy ICE agents to polling places is being justified as an election integrity measure, but it is nothing short of voter intimidation and unconstitutional federal overreach. The United States Constitution explicitly provides states—not the federal government—with the authority to determine the times, places, and manner of holding elections.
 
Currently, Pennsylvania law prohibits on-duty police officers from being within 100 feet of a polling place unless called upon to preserve the peace. Unfortunately, and to the detriment of our citizens who may be targeted by ICE based only on ICE’s practice of focusing on certain ethnicities, this law is an insufficient protection against federal voter intimidation. To provide clarity and ensure true election integrity, we will be introducing legislation to prohibit federal agents from being at polling places on Election Day. This legislation is necessary to assert, in no uncertain terms, that Pennsylvania has the authority to govern its elections and protect its voters from intimidation.
 
According to recent survey data, a majority of voters support blocking ICE enforcement actions at polling locations, and this is for good reason. No eligible voter should face fear or intimidation when attempting to exercise their right to vote.
