Act 92 of 2022 prohibited the use of off-road vehicles such as dirt bikes and ATVs in cities statewide. It further provided for penalties and forfeitures of these vehicles. Nevertheless, off-road vehicle use on city streets remains a serious issue across the Commonwealth– jeopardizing the safety of motorists, bicyclists, and pedestrians alike. Many cities, including Philadelphia, had a local ordinance in place prior to the passage of Act 92 with stronger penalties than those now required by state law. Unfortunately, these local ordinances with stronger penalties are now preempted by Act 92. For the safety of our residents, we must give our cities the necessary tools to address this threat to public safety.
 
For this reason, I intend to reintroduce House Bill 1338 from last session which simply gives our cities the option to enact local ordinances with stronger penalties for off-road vehicle use on city streets than what is currently prescribed by Act 92. This will allow our cities to adopt stronger ordinances and combat the dangerous use of off-road vehicles on city streets and increase safety for everyone living, working, and visiting our urban centers.
