In the near future, we plan to introduce legislation to ensure that every rape kit in the Commonwealth is tested.
 
Our legislation will amend the Sexual Assault Testing and Evidence Collection Act to standardize the submission process for all kits obtained by law enforcement. Presently, the statutory definition of “awaiting testing” includes a provision requiring local authorization before a kit is submitted. While well intentioned, this leads to a non-uniform process that has resulted in inconsistencies and delays in testing.
 
Our bill makes a targeted technical correction to ensure that every kit is submitted promptly and consistently, helping to preserve critical evidence, support investigations, and provide survivors with the certainty that their cases are being handled with urgency and care.
 
The Pennsylvania Commission on Crime and Delinquency recommended this change as part of their annual report required by the Sexual Assault Testing and Evidence Collection Act.
