In recent years, health insurers have increasingly relied on AI technology to handle claims and prior authorization requests. While these systems can enhance efficiency, they also raise significant concerns regarding potential inaccuracies and biases in healthcare decision-making. There have been instances where erroneous algorithm-driven denials have resulted in serious health complications or even fatalities.
Artificial intelligence holds tremendous promises for improving healthcare delivery, but it must never supplant the skills and judgment of medical practitioners. An algorithm lacks the ability to fully grasp an individual patient's medical history or specific needs, and misapplication of these tools can lead to catastrophic outcomes.
This proposed legislation will ensure that human oversight is central to healthcare decision-making, protecting Pennsylvanians' access to the high-quality care they rightfully deserve. Under this new law, any denial, delay, or alteration of care based on medical necessity will be subject to review and determination by a licensed physician or qualified healthcare provider with expertise in the relevant clinical matters. Additionally, the legislation will set clear and fair standards for companies using AI in their utilization review processes, helping to prevent unethical behavior and ensuring patient welfare is prioritized.
