We plan to introduce legislation that would allow construction projects involving land disturbance of more than one acre but less than two acres to apply for a waiver from the required National Pollutant Discharge Elimination System (NPDES) permit.
Many states surrounding Pennsylvania already participate in the federal NPDES waiver program.  In cases where construction activities pose minimal environmental impact, the NPDES permitting process can impose an unnecessary financial burden on landowners. Pennsylvanians should not be subject to an additional regulatory framework when they are already in compliance with federally mandated requirements. This legislation would bring Pennsylvania’s NPDES program into alignment with federal standards and those of neighboring states.
